SecureWay Financial

Terms of Service

Effective Date: September 20, 2026

These Terms of Service (the "Terms") are a binding agreement between you and Secure Way Debt Relief LLC ("SecureWay," "we," "us," or "our"). By using our Services, submitting a request, or communicating with us, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Services.

These Terms contain an arbitration agreement and class action waiver in Section 12. Please read that section carefully — it affects how disputes between you and SecureWay are resolved.

1. Agreement to These Terms

These Terms govern your use of securewayfinancial.com, our landing pages and online questionnaires, our phone, text, and email communications with you, and the marketing and referral services we provide (together, the "Services").

2. Eligibility

You may use the Services only if you are at least 18 years old, reside in the United States, and are using the Services for your own personal, noncommercial purposes. By using the Services, you represent that these things are true and that all information you give us is accurate, current, and complete.

3. What SecureWay Does and Does Not Do

SecureWay is a marketing company. We collect information about your financial situation and refer you to one or more independent companies or law firms that offer debt relief and related services (each, a "Provider").

SecureWay is not a Provider. We do not provide debt settlement, debt negotiation, credit counseling, credit repair, tax, legal, or financial advice, we do not negotiate with creditors, and we do not hold or handle your money. Any decision to work with a Provider is yours alone — review a Provider's own agreement and disclosures before you enroll in anything.

The Services are free to you. We are paid by Providers and marketing partners when we refer consumers to them or when consumers enroll, and that compensation may influence which Providers we refer you to.

5. No Guarantee of Results

We do not guarantee that any Provider will contact you, accept you into a program, or achieve any particular result. Providers are independent businesses we do not own or control, and are solely responsible for the services they provide. Debt relief programs carry risks — including continued collection activity, negative effects on your credit, and tax consequences on forgiven debt — and results vary. Any estimate, example, or testimonial is illustrative only.

6. Acceptable Use

You agree not to violate any law; submit false or misleading information, or information about someone else without permission; interfere with the Services' operation or security; access the Services via bots or scrapers; copy or reverse engineer any part of the Services; or use the Services to harass, defraud, or harm anyone. We may suspend or terminate your access at any time if we believe you have violated these Terms.

7. Intellectual Property

The Services — including text, graphics, logos, forms, and software — are owned by SecureWay or its licensors. You may use the Services only to request a referral and learn about debt relief options; you may not copy, reproduce, distribute, or create derivative works from them, or use our name or logos, without our written permission.

8. Third Party Websites and Providers

The Services may link to Provider and other third-party websites. We do not control and are not responsible for their content, accuracy, or practices. Your dealings with any Provider or other third party — including any agreement or payment — are solely between you and that party; SecureWay is not a party to them.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, SecureWay disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, and any warranty that the Services will be uninterrupted, error free, or secure, or that any information on the Services is accurate or complete. SecureWay makes no warranty about any Provider or about the Services or results of any Provider.

10. Limitation of Liability

To the fullest extent permitted by law, SecureWay and its members, managers, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to the Services, these Terms, or your dealings with any Provider, even if we have been advised of the possibility of such damages. In no event will our total liability to you for all claims exceed one hundred dollars. Some states do not allow certain limitations of liability, so some of these limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless SecureWay and its members, managers, officers, employees, agents, and affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, your violation of any law or third party's rights, or any inaccurate information you provide to us.

12. Dispute Resolution, Arbitration, and Class Action Waiver

Informal resolution first. If you have a dispute with SecureWay, you agree to first contact us (Section 15) and give us 30 days to try to resolve it informally before starting arbitration or a lawsuit.

Agreement to arbitrate. Except as provided below, you and SecureWay agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, our communications with you, or your relationship with SecureWay — including any claim under the Telephone Consumer Protection Act or state telemarketing/consumer protection law, and any question about the scope, validity, or enforceability of this arbitration agreement — will be resolved by binding individual arbitration before JAMS rather than in court, under the JAMS Streamlined Arbitration Rules (claims under $250,000) or Comprehensive Arbitration Rules (all other claims), as modified by these Terms and subject to the JAMS Consumer Arbitration Minimum Standards. The Federal Arbitration Act governs this agreement. Any hearing takes place in the county where you live or by video conference, at your choice.

Attorneys' fees. Each party pays its own attorneys' fees and expenses, except where a statute allows a fee award to the prevailing party, or where the arbitrator finds a claim, counterclaim, or defense frivolous or improperly motivated under the Rule 11(b) standard — in which case the arbitrator may award reasonable fees and costs to the other party. This never requires a California consumer who does not prevail to pay SecureWay's fees or costs.

Arbitration fees and costs. If you start an arbitration, you pay the consumer filing fee (currently $250), and SecureWay pays the remaining JAMS fees and the arbitrator's professional fees, per the JAMS Consumer Arbitration Minimum Standards. If SecureWay starts one, SecureWay pays all JAMS and arbitrator fees, subject to reallocation if your claim is found frivolous as described above.

Class action waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding, and the arbitrator may not consolidate claims of more than one person. If this waiver is found unenforceable as to a particular claim, only that claim proceeds in court instead of arbitration.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek an injunction in court to protect its intellectual property.

Your right to opt out. You may opt out of this arbitration agreement by sending written notice within 30 days after you first submit a request through the Services, including your name, address, phone number, email, and a statement that you want to opt out of arbitration. If you opt out, the rest of these Terms still apply.

Jury waiver and governing law. To the extent any claim is heard in court, you and SecureWay each waive any right to a jury trial. These Terms are governed by the laws of the State of Texas, and any court proceeding will be brought in the state or federal courts in Collin County, Texas.

13. Electronic Communications

You agree that we may provide notices, disclosures, and other communications electronically — by email, text, or posting on the Services — and that this satisfies any legal requirement that a communication be in writing. Your electronic submission of a form, your typed name, or a click on a button labeled submit, agree, or similar, constitutes your electronic signature with the same effect as a handwritten one.

14. General Terms

We may change these Terms at any time by posting an updated version and changing the Effective Date above; continued use after a change takes effect means you accept it. If a provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or successor. These Terms, our Privacy Policy, and the consent language on our forms are the entire agreement between you and SecureWay regarding the Services.
